Terms & Conditions for Peoples Coffee Website

Your Acceptance to use Peoples Coffee:
By visiting this site or by becoming a peoplescoffee.co.nz member you accept these terms and conditions.

Refund Policy
If the mistake is made by Peoples Coffee we will either refund, replace or discount your order at our discretion. However if the mistake is made on the customers part it may be possible to negotiate a refund on merchandise at our discretion. Ground coffee will not be accepted for a refund under any circumstances due to its short shelf life.

Delivery Policy
If your order is placed by 7 AM on a given business day, it will be roasted and dispatched by courier on that day. If your order is received after 7 AM on a given business day, it will be roasted and dispatched by courier on the next business day. The courier should deliver either the same working day or on the following morning. Rural delivery is available at a fee if specified with the order. We do not presently ship to P.O. boxes, or outside  New Zealand.

Newsletter
By selecting the “I would like to receive the monthly Peoples Newsletter” option provided on the checkout form you authorize us to send you monthly newsletters in email format. You will always be provided with the option to opt out of this at the bottom of each non-order related email.

Third Party Sites
These terms apply to all users of Peoples Coffee. Peoples Coffee may contain links to third-party websites that are not owned or controlled by Peoples Coffee. Peoples Coffee will not censor or edit the content of any third-party site. You relieve Peoples Coffee from all liability arising from your use of any third-party website. We encourage you to read the terms and conditions and privacy policies of other websites you visit.

Peoples Coffee Website Access
We give you permission to use the site provided that: your use is solely for your use; you will not copy or distribute any part of Peoples Coffee without our prior written permission, and you will not alter any part of Peoples Coffee other than in areas that you are entitled to.

You must never use another person’s Web Shop account without permission. You must provide accurate and complete information. You are solely responsible for the activity on your account and you must keep your account password secure.

You must notify us immediately of any breach of security or unauthorized use of your account. Although Peoples Coffee will not be liable for any losses caused by unauthorized use of your account, you may be liable for the losses of Peoples Coffee’s or others due to such use.

We reserve the right to suspend or terminate your account if you breach theses terms and conditions or when Peoples Coffee consider it appropriate.

Privacy
Our Web Shop system collects and saves your personal information, except credit card details, which are handled securely by Payment Express. All data and information collected by us is treated confidentially respecting the applicable laws on data protection and in accordance with our Privacy Policy.

Warranty Disclaimer and Limitation of Liability
We do not endorse any opinion, recommendation, or advice expressed on the site and disclaim any and all liability in connection with content or comments posted on the site.

We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third-party through this site and will not in any way be responsible for any transaction between you and third-party providers of products or services. You should use your best judgement and exercise caution where appropriate.

You agree that your use of the Peoples Coffee site is at your sole risk. Peoples Coffee makes no warranties or representations about the accuracy or completeness of this site’s content or the content of any sites linked to this site.

You agree that, Peoples Coffee has no liability or responsibility for any inaccurate content; personal injury or property damage resulting from your access to and use of this site; any unauthorised access to or use of the secure servers and any personal and/or financial information stored there; any interruption of transmission to or from this site; any bugs, viruses, trojan horses, etc which may be transmitted to or through this site by any third party, and/or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content made available via this site.

The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

Indemnity
You agree to release, indemnify and hold harmless Peoples Coffee, its parent corporation, officers, directors, employees and agents, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees and expenses) arising from: your use of and access to the site; your violation of any term of these terms of service; your violation of any third party right, including without limitation any copyright, property, or privacy right; or any claim that one of your content items for sale or comments caused damage to a third party. This release and indemnification obligation will survive these Terms and Conditions of Use and your use of the Peoples Coffee site.

You understand that by using this site, you may encounter content that may be deemed offensive, indecent or objectionable. You agree that the use of this site is at your own risk and that Peoples Coffee has no liability to you for content that may be offensive, indecent or objectionable.

Variation
Peoples Coffee reserves the right to vary these terms and conditions either in whole or in part from time to time. Amendments will take effect immediately when they are posted on the site. You are responsible for ensuring that you are aware of the latest terms and conditions. By continuing to use this site you agree to be bound by the terms and conditions as amended.
